1. Acceptance of Terms
By registering an organization account, deploying a performance agent, or using the PerformancePlatform software services (the "Service"), you agree to be bound by these Terms of Service. If you are entering into these terms on behalf of a company or legal entity, you represent that you have the authority to bind such entity.
2. Authorized Use & Load Generation
You agree to only dispatch performance tests and synthetic loads against endpoints, infrastructure, and target systems that you own, operate, or have explicit written authorization to test. You must not use the Service for denial-of-service (DoS) attacks, unauthorized stress testing, or scanning third-party applications without permission.
3. Subscription Cycles & Execution Quotas
Paid subscriptions are billed on a recurring monthly or annual basis via Razorpay. Each plan includes a defined monthly test execution allowance. Unused test executions do not roll over to subsequent billing cycles. Exceeding your allowance requires upgrading to a higher tier.
4. Tenant Isolation & Security
PerformancePlatform enforces organization-level tenant isolation. API credentials and authentication tokens stored within the platform are protected using cryptographic encryption. You are responsible for safeguarding your user credentials and agent registration tokens.
5. Disclaimer & Limitation of Liability
The Service is provided on an "as is" and "as available" basis. PerformancePlatform does not guarantee specific application throughput improvements. In no event shall PerformancePlatform be liable for incidental, indirect, or consequential damages arising from load test execution or network degradation.
